Once the complaint is filed, it will be served to the defendant either in person or, on rare occasions, by mail. The defendant is usually given 21 days to respond to the claim. This timeframe gives the defendant time to hire his or her own attorney. In the response, the defendant may address the allegations, typically denying the majority (if not all) of them or asking for a motion to dismiss. A motion to dismiss contends that despite everything in the complaint being true, the facts do not establish liability. If the defendant neglects to respond altogether, he or she runs the risk of the plaintiff receiving a default judgment: Entitling the plaintiff to collect his or her judgment using all legal means available.
